1. General Terms & Conditions

1.1 In General

These General Business Terms shall apply to all business relationships between the Customer and Chic Bathroom in their version which is valid at the time of the order for deliveries of all kinds, which Chic Bathroom provides towards its Customer insofar as no contradictory written agreements are reached in a purchase or other contract concluded between Chic Bathroom and the Customer. Legally relevant declarations and notifications of the Customer after conclusion of the contract (e.g. setting of deadlines, reports of defects, declaration of cancellation or reduction), require a written form in order to be valid.

 

2. Conclusion of the contract

All offers of Chic Bathroom are without obligation.

After receipt of this offer the Customer shall receive an electronic confirmation from Chic Bathroom about the receipt of the order, in which the data and the articles ordered by the Customer are listed once in which the data and the articles ordered by the Customer are listed.

 

 

3. Delivery date, terms of delivery and shipping cost

3.1 Delivery date:

Chic Bathroom shall deliver goods which can be delivered immediately within three (3) workdays after you placed the order to the address stated by you. The delivery times for all products depend on the product and are stated on our website for each product. Should it not be possible to ad-here to the expected delivery date Chic Bathroom shall inform you hereof and notify you of the new delivery date.

 

3.2 Delivery of Goods:

The delivery of goods to you is deemed to be a separate contract for services, distinct from your contract to purchase the goods. Delivery may be affected in one or more instalments. If you or whomever you have appointed to receive delivery are not available to receive the delivery on the assigned day and the courier has attempted to make delivery you are now liable for the additional re-delivery charge and goods will not be re-delivered until this fee has been paid.

  • If your pallet or parcel is visibly damaged, please DO NOT  accept delivery.

  • If the courier will not wait for the goods to be checked DO NOT sign for your delivery.

  • Please Use Caution when un-wrapping the pallet(s) as items may have become unsteady during transit.

You or whomever you have instructed to receive your delivery must open and check your order for damages prior to signing any paperwork from the courier – in the unlikely event that an item(s) has been damaged note this on the courier’s POD (Proof of Delivery) – ‘DAMAGED’ along with product description. You agree to indemnify us in full for any losses we suffer as a result of your failure to comply.

Claims for damages will not be accepted if this has not been completed.

You or whomever you have instructed to receive your delivery is required to sign Proof of Delivery and detail any damages at this point – the words ‘unexamined’’ or ‘unchecked’ will not be accepted as a conditional signature. Any signature on delivery paperwork is accepting that the goods arrived without obvious external damage to the packaging and later claims for damage will not be considered.

Do not refuse the delivery unless every item is damaged. If you refuse a delivery with any undamaged items on it you will be charged for the return and the redelivery of those items. For large pallet deliveries please be aware that the costs will be considerably higher than the fee you are charged for delivery.

The delivery drivers are not insured to assist with the unpacking of deliveries. The delivery drivers are not insured to take their vehicles on roads other than public highways. If you live in a remote location and your home is not on a public road, e.g. If you live at the end of a farm track, then the driver will deliver the goods to the end of the public road only. You accept this when placing your order and if you refuse the delivery because of the driver being unable to drop at your door then you will be charged the actual delivery costs and collection fees. (This will apply to large or very large item orders arriving on pallets like bathroom suites or shower enclosures. Smaller parcels can be usually delivered on foot by the driver.)

Delivery dates are approximate and no liability whatsoever is accepted in respect of late deliveries.

In the unlikely event that an item has been damaged in transit please contact Chic Bathroom by E-Mail: info@chicbathroom.ie within 24 Hours of receiving your delivery to ensure that you are provided with the replacement as soon as possible.We will not accept liability for any shortages if they are not reported within this period.

 

3.3 Shipping costs:

FREE shipping costs  for all the products published on our website.

Countries: Republic of Ireland, UK,  France, Spain  free shipping for all the items .

All other countries : Please contact us via Email: info@chicbathroom.ie  if you would like to know the shipping cost to a country not mentioned in our list of destination countries.

 

 

4. Cancellation and Return of Goods:

Please note : we cannot accept returns at our office in person. Please arrange for a courier, or alternatively.

If you change your mind on your purchase and no longer want the items, we will accept returned goods provided it is within 14 working days of receipt. You will be responsible for the return of the products and all costs associated with this.
All cancelled goods must be returned in its original packaging and in a re-sellable condition. We will not accept or refund any items that are damaged whilst in your possession or in transit back to us.

Please note: we are unable to accept cancellation at any stage if any item is ordered with any personalisation or items custom manufactured to your specification.

 

4.2 Return of Faulty Goods Received:

We ask that customer fully inspect all products received on the day of delivery. To ensure a speedy resolution, we must be notified of any items that arrive faulty or damaged within 24hrs of receipt. We will then advise the next course of action, we will contact you and either arrange collection, ask for goods to be returned back to us or disposal of goods, never dispose of goods without our notification. Should we request that you send goods back to us, we ask that you include a receipt for any postage costs that you may incur so that we may refund the full cost of postage.

Please note: All goods reported as faulty will be tested by manufacturers, if it is determined the goods are not faulty or if the faults are deemed to be caused by damage or abuse this will void any warranty, goods will be returned to you and no refund or replacement issued.

 

5. Prices

The prices stated on the website www.chicbathroom.ie apply. These include the applicable rate of value added tax and are deemed.

 

6. Payment

Chic Bathroom offers the payment by credit card, debit card, PayPal.

 

7. Warranty

All products from Chic Bathroom come complete with a minimum of 12 months Manufacturers Guarantee, many products are listed with periods longer than 12 months, in these cases the period listed is still a Manufacturers Guarantee. Should any of your products develop a fault during the manufacturer’s warranty period we still ask you to contact us initially, we will then advise you on the next steps. Different manufacturer’s have different procedures for dealing with faults, on some occasions we will deal with the replacement of goods on their behalf, some companies will only deal with customers direct so we will provide you with all the relevant contacts and information, they will then arrange repair, replacement or advise alternative procedures.

8. Product presentations and guarantees

The product presentations on the website can deviate in colour and impression from the actual articles. References to the products do not represent any guarantee. An additional guarantee only exists with the goods delivered by Chic Bathroom if this was explicitly stated on the website for the respective article. If applicable, special guarantee terms from the manufacturer of the article will also be shown on the website.

 

9. Liability

The liability of Chic Bathroom is oriented to the following provisions:

9.1 Chic Bathroom shall be liable for damages, which are caused by it or its legal representatives or vicarious agents by wilful intent or gross negligence, unlimited with respect to the amount.

9.2 For damages from the injury to life, body or health Chic Bathroom shall also be liable with own, slightly negligent breach of duty or that of its legal representatives or vicarious agents unlimited with respect to the amount.

9.3 In case of negligent breaches of duty Chic Bathroom shall be liable for damages from the breach of essential contractual duties, without which it is not possible to achieve the object of the contract and the compliance with which the Customer can as a rule rely upon, limited with respect to the amount to the typically foreseeable damages for the contract. This shall apply accordingly to the negligent breach of essential contractual duties of the legal representatives, executive bodies or vicarious agents of Chic Bathroom.

 

10. Data protection

10.1The data collected from the Customer within the framework of his order shall be processed and used by Chic Bathroom for establishing, executing and terminating the contractual relationship with the Customer, in particular also for processing warranty claims. Personal data of the Customer will only be forwarded to third parties if and insofar as this is necessary for executing the contract, in particular for carrying out the delivery.

10.2 The use of the e-mail address for advertising purposes is only carried out if the Customer has granted his consent in this respect. The same shall apply accordingly to the use of such data for market or opinion research.

 

11.  Law and jurisdiction

These terms and conditions will be governed by and construed in accordance with Irish law, and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of the Republic of Ireland.
